Terms of Service

Please read these terms of service carefully. They govern your access to and use of the services provided by the California Department of Education (CDE) in the Web site, TEACH California at http://www.teachcalifornia.org/ (referred to herein as "the Site.")

By accessing the Site and/or using any of the services or tools provided, you agree to be bound by these Terms of Service. Access and use of the Site in the future constitutes an agreement to continue to be bound by these Terms of Service or any additional or other terms added or substituted in the future.

Services of the Site

The Site provides services and tools for learning about teaching as a career, credentialing requirements, planning and preparing for a teaching career in California, and finding a job as a teacher.

The CDE reserves the right to revise, enhance, add or remove tools and features from current Services at any time without notice or liability to you or any third party. However, CDE is under no obligation to update or upgrade any tools, features, data, links or services on the Site. Any new, enhanced or modified services provided in the future by the Site shall be governed by these terms of service unless explicitly stated otherwise.

Content

You acknowledge that CDE does not evaluate Content for accuracy, appropriateness, timeliness or reliability and that its availability on the Site does not constitute an endorsement or warranty of any kind by CDE. You agree that inclusion of any Content on the Site does not constitute or imply any advice or recommendation by CDE for you or any third party to take any particular course of action or inaction. You agree that CDE is not responsible for and will have no liability for any reliance by you or any third party on such Content.

Intellectual Property and Copyright Notice

The CDE and its partners and affiliates reserve and retain all intellectual property rights to the Site, its Services and Content. You may not publish, modify, transmit, transfer, sell, rent, reproduce, link, display perform, create derivative works from or in any way exploit the intellectual property of the Site except as explicitly provided in this agreement or with the prior written consent of CDE.

Copyright Infringement

The CDE recognizes the intellectual property rights of others and expects the same of those using the Site. If you think that your intellectual property has been used in a way that infringes on your copyright, please contact us.

Links

The Site or its Content may contain links to other Web sites. Inclusion of such links does not constitute or imply evaluation, endorsement or warranty of the accuracy or suitability of other Web sites by CDE, including, but not limited to, content, advertising, goods, services, links or resources found therein. You agree that you, not CDE, are responsible for determining the accuracy, reliability and suitability of any content found on other Web sites and for adhering to their terms of service. You agree to indemnify and hold CDE and its' associates and affiliates harmless from and against any claim, demand or costs made by any third party resulting from or relating to your use of links to other sites or any content found therein.

The Site is provided on an "as-is" and "as available" basis, with no warranties of any kind, expressed or implied, of availability, reliability, fitness for a particular purpose, merchantability or non-infringement. CDE does not represent or make any warranty that the Site or its services will meet your requirements or expectations, that the Site will be timely, secure, free of errors, or uninterrupted. Furthermore, CDE does not represent or make any warranty that the results or information obtained from use of this Site will be accurate, free of error, appropriate or reliable, nor does CDE represent or make any warranty that the software, hardware or communications associated with the Site will be free of error or that such errors will be corrected.

The CDE is not responsible for and has no liability resulting from downloading of programs or other materials from the Site or any other sites linked from the Site, or from any failure of the Internet or any data or telecommunications equipment, system, network or software used in conjunction with accessing the Site and using its services.

Indemnification

You agree to defend, indemnify and hold harmless and its affiliates from any suit, claim demand, losses, damages or costs made by any third party caused by or arising from your violation of this agreement or from your violation of any law or from any violation of the rights of any person or entity. However, CDE reserves the right of exclusive defense and control of any such claim, demand or suit.

Limitation of Liability

You agree that CDE, its partners and affiliates shall have no liability related to any subject contained in this agreement under any theory of law, including negligence, for any amount in excess of fifty U.S. dollars, for any lost files, content, data or any other consequential, incidental, or other damages of any kind, including, but not limited to, loss of goodwill, computer failure, the cost of obtaining substitute goods, technology or services, or other personal or commercial damages or losses.

Accessibility

The Site is designed to comply with the CDE Web Accessibility StandardsIcon indicating a URL to an external Web site, which are meant to assure the CDE's continuing compliance with Government Code (GC) Section 11135, requiring all of its agencies and departments to comply with federal Section 508 of the Rehabilitation Act of 1973. People with or without disabilities have different degrees of capabilities, software, and hardware that they use to access resources on Web sites. The Site is designed to be fully accessible to persons with disabilities.

Privacy Policy

The CDE respects the privacy of Site users, and does not sell, rent or otherwise provide personal information to third parties. However, there may links on the Site which go to Web sites owned and/or operated by third parties who may have different privacy policies. You and not CDE are responsible for knowing and understanding the privacy policies of third party Web sites before providing them with personal information.

The CDE uses personal information you may provide in two ways. It is anonymously aggregated with the information provided by others to identify trends and preferences that can be used to improve Services, and it is used to provide users with information and notices based on their individual needs and preferences.

The CDE cannot guarantee the absolute security of any personal information you might disclose, therefore any personal information you might disclose should be considered public information.
